New Developments and Assignments

Shopping the new construction market can be a challenge. Make sure your interests are protected at all times by having an experienced Realtor represent you.

Buyers often do not realise that when they purchase directly from the developer they have no agency representation. This means no one is looking out for their best interests. The Developer's purchase agreement is generally very one sided and always in favour of the developer. For example, did you know:

  • Some developments may never complete - your compensation for damages if the development does not complete is minimal if any.
  • If your payments are not made on time you could loose your deposit and the Vendor could also cancel the agreement.
  • Completion dates could be as much as two years behind schedule - possibly even later.
  • The final in-suite finishes and dimensions can often differ considerably from the orginal plans, show-room and brochures shown at the time of purchase.
  • If your intention is to assign before completion, be careful! Some agreements might prevent you from assigning.
These are just a few items you might encounter in a purchase agreement. Remember, before you walk into a new developement show-room make sure you have proper representation with the help of an experienced Realtor.

New Contruction Considerations

  • GST needs to be paid on all new construction. You may be entitled to a partial rebate.
  • Developers often require a minimum downpayment of between 10% and 35%.
  • Unlike resale homes, the list price on new homes is generally not negotiable.
  • Completion dates can and often do change. The contract will often allow the developer to deliver your unit at a much later date than that specified in the contract. Speak to your Realtor if this is a concern.
  • Parking is normally considered an extra and not included in the list price. The cost can range from $15,000 to $35,000 depending on the building. It's always a good idea to buy a parking space even if you don't have a car as this will help in its future sale.

Assignments

An Assignment Sale is when the original purchaser sells and/or transfers all the rights and obligations of the original contract between themselves and the Vendor to another party before the official completion date for the property. Title transfer for the property does not occur until the city issues the necessary permits and the unit is ready for occupancy.

In an assignment sale you are only purchasing or selling the contractual rights and obligations to a property until the unit is complete, not the physical property itself.

If you purchased a property that is under construction and wish to re-sell it before it is completed you should first check the terms of your contract, as assignments may be restricted. Also, developers often charge an administration fee for assignments which you would need to pay.
